Kashmir Treks respects your privacy and recognizes the need to protect the personally identifiable information (any information by which you can be identified, such as name, address, email, and telephone number) you share with us. We would like to assure you that we follow appropriate standards when it comes to protecting your privacy on our web sites.

We assure you that we at Kashmir Treks take all reasonable measures to maintain your privacy and security regarding personal information that you voluntarily divulge to us. We take this seriously! During the course of communication and or tour reservations, we collect information that you voluntarily disclose to us, including but not limited to name, address, phone, and email. This information may come to us from an associated third party, such as a person who is the primary organizer or contact person of a group, or from a travel agent. KT may choose to retain such information in its database. We may utilize, within the company, such information for our occasional mailings, email notices, or even phone calls for the purposes of advancing the program of KT.

However, we will not share or sell that information with any other company/entity for commercial purposes.

Furthermore, we will not collect from your personal computer or any other source, additional information about you beyond what you have voluntarily given to us.

There are some limited circumstances in which we may have to disclose your information: if required by law or if we are required to do so by law-enforcement authorities, or if we believe in good faith that the information you have provided us is necessary to disclose to the appropriate authorities for the protection of rights, property, or safety of our company and its users.

KT uses state of the art efforts to secure the confidentiality of your personal information. Unfortunately, internet security is not perfect. For example, third parties may unlawfully intercept or access transmissions or private communications. Please use appropriate caution before you disclose personal information to any internet site, and realize that some companies take ensuring your privacy much more seriously than others.

Cookies

When you visit our online website, we do not place any “cookie” to collect any type of browsing data in any form. You can check that and remove or block such cookie if exists. Click the padlock icon next to the site name and remove or block cookies.

For the purpose of the Information Technology Act, 2000, the (Indian) Contract Act, 1872 and ODR, the data controller Kashmir Treks is registered with the Department of Tourism, Government of Jammu and Kashmir as Kashmir Alpine Treks.

If our privacy policy changes in the future, it will be posted. You should access our privacy policy regularly to ensure you understand our current policies. Please reference the privacy policy in your subject line. Kashmir Treks will attempt to respond to all reasonable concerns or inquiries within seven business days of receipt.

Please read the following booking agreement terms and conditions carefully. These terms and conditions together with our privacy policy, release and waiver, and any other documentation we provide you form the basis of your contract with us (hereinafter The Agreement). This Agreement effects your legal rights. By booking a tour with us, you are accepting and consenting to The Agreement. If you do not agree to the Terms and Conditions, you must not make any booking with us. We reserve the right to change these Booking Terms at any time. The Booking Agreement Terms and Conditions that are in effect at the time of your travel will be applicable. It is your responsibility to check these Booking Terms and Conditions from time to time and be aware of any changes in effect before you travel.

The terms “we”, “us”, “our”, and “Kashmir Treks” refer to Kashmir Treks. The term “you” “I” “participant” or “customer” refers to the customer booking a reservation through us. Reference to “Suppliers” and “Service Providers” means all third parties who provide services to you including airlines unless otherwise specified.

By making a booking with us, you affirm that you are at least 18 years of age and possess the legal authority to enter into this agreement in accordance with all Terms and Conditions herein. If you are making travel reservations or bookings for another person you agree to inform that person(s) about the Terms & Conditions that apply to the travel reservations and bookings you have made on their behalf, including all rules and restrictions applicable thereto and these Terms and Conditions. You agree to be financially responsible for all bookings you make. You are responsible for any bookings and travel reservations made by persons under your direction or control. You also warrant that all information supplied by you or on your behalf, or by members of your household is true, current, complete and accurate. Furthermore, you also confirm that the traveler is not an unaccompanied minor.

Our guides may take photographs in the course of their leading our treks. We may sometimes include these photos on our website, and some of these images may include our clients in the trekking. We will honor any request by a client to not have her or his photo so utilized, and we will also honor any request by any client to have her or his existing photo on the website removed from the website.

To register for a Kashmir Treks tour, submit a form corresponding tour on our website. A 30% deposit of the tour will be charged in order to hold your spot; payment can be made by PayPal or bank-transfer. The balance of your payment is due 90 days prior to departure. All prices are in Indian Rupee (INR).

Upon receipt of your deposit, you will receive a confirmation letter and an itinerary note to help you prepare for your trip.

Because many of our tours fill up three months in advance, we suggest reserving early. In addition, the sooner you decide on a tour, the more time you will have to read through our materials and get ready for this unique travel experience.

Prices shown are based on double occupancy both in a tent or a hotel/ houseboat. If you would like your own tent or room in a hotel or houseboat, there is an additional single supplement charge. Please understand that many of our hotels and houseboats charge the same for single and double rooms, especially if the hotel or houseboat is full.

Special diets should be requested on the Kashmir Treks booking form; however, it may not be possible for special diets to be catered to in some of the destinations we feature. For safety and liability reasons, Kashmir Treks and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and is not responsible for any issues or problems associated with the same. We will advise the hotels and houseboats of your request but we cannot guarantee their availability.

The client must be in possession of a valid passport (for Indians a valid ID card) and all visas required for the whole of the journey and the client accepts responsibility for obtaining the same. Any information or advice given by the company on climate, clothing, baggage, special equipment, etc is given in good faith but without responsibility on the part of the company.

We will prepare your trek permit using the personal information that you send us with the trek application. You must bring your passports or ID cards with you and take them on the trek. If the information in your passport or your ID card is different from that provided in the trek application, the government authorities will not allow you to start the trek and you will not be entitled to a refund.

Failure to bring the required travel documents will be treated as a cancellation of the trek by the client.

We reserve the right to cancel any trip, for any reason, at any time prior to departure. In this case, refund of any payments received constitutes full settlement. This will not apply in the case of Force Majeure. There is no refund for travelers arriving late or unexpectedly leaving a trip. Kashmir Treks does not recommend the purchase of nonrefundable airline tickets.

The cancellation charges are as under:
Cancellations prior to 60 days from the start of the trip — full refund.
Cancellation between 60 days and 30 days to the start of the trip — 50% refund.
Cancellation less than 30 days to the start of the trip — no refund.

Covid-19

Clients are entitled to a full refund only if the cancellation is solely related to the Covid-19 pandemic. The trips can also be rescheduled or postponed without any extra charge.

We will gladly answer questions to help you select a tour or provide you with names of past participants who will candidly describe their experience with Kashmir Treks. However, you are responsible for selecting a trip appropriate to your physical abilities and interests, carefully reading all of the detailed pre-departure information before traveling, and being in sufficiently good health to undertake the trip.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. Kashmir Treks is not responsible for any costs incurred concerning a guest removed from a vacation/holiday. Guests agree not to hold Kashmir Treks or any of its related entities liable for any actions taken under these terms and conditions.

KT’s trek itineraries have been designed to provide participants with an exposure to the true nature of the environment visited and therefore involve an element of personal risk and exposure to potential hazards over and above those associated with normal “package” holidays. The client acknowledges that the nature of the tour is adventurous and that such activities may involve a significant amount of personal risk. We advise you to read and understand high altitude precautions.

Children under eight years old must be at all times accompanied by a parent. Parents are responsible for bringing all the required amenities, which are not provided by Kashmir Treks.

Traveling in a group invariably involves compromise to accommodate the diverse interests, travel goals, personalities, and physical abilities of all participants. Kashmir Treks tour leaders may be required to improvise and exercise good faith, use discretion, and/or make decisions based upon group consensus. These decisions may not always please each individual, but they are intended to satisfy the desires of the larger group.

If a tour does not reach a group size of 6 participants within 20 days prior to departure, we offer guests the chance to move to a different tour. If you wish to stay, only 1 guide will be provided and each guest will have to pay an additional 20% charge.

We emphasize the group size of a tour to maximize every guest’s enjoyment and support. On our regularly scheduled tours (excludes private and custom), our average group size is 14, and our maximum is 18 with two guides. In the rare case we run a tour with 5 guests or less only 1 guide will be provided. If we run a tour with over 18 guests, there will be at least 3 guides. Kashmir Treks shall not be responsible for, and shall make no refund for, events beyond its control, such as, without limitation, acts of God, strikes, acts of war, terrorism or civil disturbance, government restrictions, curfews, changes of schedules or operational decisions of air carriers, terrorist activity or the threat thereof, industrial action, natural or nuclear activity, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation, adverse weather conditions, fire, or for acts or omission of Third Parties or other parties not under the control of Kashmir Treks and all similar events outside our control.

Kashmir Treks, and its employees, shareholders, agents, and representatives use third party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to this tour. Kashmir Treks is an independent contractor and is not an employee, agent, or representative of any of these suppliers. Kashmir Treks does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. Kashmir Treks is not affiliated with any other tour operator. All suppliers are independent contractors, and are not agents or employees or representatives of Kashmir Treks. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all customers agree that neither Kashmir Treks, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour participant or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Kashmir Treks. Kashmir Treks assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any participant that may result from any act or omission on the part of others; and Kashmir Treks shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic/pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. Kashmir Treks accepts no responsibility for lost or stolen items. Kashmir Treks reserves the right to refuse any participant or potential participant at its sole discretion.

Additional risks and dangers may arise including, but not limited to, hazards of travel by train, automobile, motor coach, aircraft, bicycle and other means of conveyance, animal interactions, forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with Kashmir Treks to participate in such trips and activities you agree you will not make a claim against Kashmir Treks, its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release Kashmir Treks, its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.

Where the guest occupies a motor coach or other vehicle seat fitted with a safety belt, neither Kashmir Treks nor the Operator nor its agents or co-operating organizations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that the Operator or its agents or affiliated entities are liable in other circumstances.

Due to political and cultural differences, as well as generally tougher physical conditions, travel to the areas we visit involves risks other than those we take in our daily lives. It is important clients make themselves aware of the risks involved, and are responsible for making their travel plans accordingly.

Kashmir Treks will not assume responsibility for any overseas company or person who fails to provide services that have been contracted for any of its tours. (In the case of such an event, alternative services will be sought.) In rare instances, we may ask a traveler to switch to another trip from one that has logistical problems or too few participants; in such cases, we will attempt to notify you at least 60 days before the departure date.

At all times the decision of the company’s guide or representative will be final on all matters likely to endanger the safety and well being of the tour group. The client must at all times strictly comply with the laws, customs, and drug regulations of Jammu and Kashmir. Should the client fail to comply with the above, or should the client interfere with the well being of the group then the guide or company representative may order the client to leave the tour without recourse to any refund.

These Booking Conditions and any agreement to which they apply are governed in all respects by the laws of Jammu and Kashmir without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Srinagar.

If a client has a complaint against KT the client must first inform the trek guide or company representative while on the tour in order that the guide/representative can attempt to rectify the matter. Any further complaint must be put in writing to the company within 7 days of the end of the tour.

At all times your contract will be with Kashmir Treks. The name Kashmir Treks is (licensed with Kashmir Tourism Department as KASHMIR ALPINE TREKS #JKEA00001727).
